Maryland passed a law in 2016 requiring commercial health insurance plans to provide coverage for male sterilization service without a co-payment, co-insurance, or deductible. With limited exception, the law applies to fully-insured policies, contracts and health benefit plans that are issued, delivered or renewed in Maryland on or after Jan. 1, 2018. In accordance with this mandate, UnitedHealthcare will provide coverage for male sterilization service without a co-payment, co-insurance, or deductible beginning Jan. 1, 2018 in Maryland.
Health Savings Account (HSA)-qualified high deductible health insurance plans (HDHPs) are prohibited from covering any benefits before the deductible is met, except for IRS-approved preventive care services. The Maryland Insurance Administration is seeking clarification from the IRS on federal HSA rules to determine if male sterilization is considered a preventive care service for purposes of HSA-qualified HDHPs. The IRS does not specifically outline male sterilization as a preventive care service. If the IRS does not consider male sterilization to be a preventive care service and your clients' employees fund a non-HSA qualified HDHP, they may be subject to tax penalties. Clients and members should contact their tax or other appropriate professional if they have questions.
